Well, since we’re talking about domestic violence cases here, what is the most challenging part of a violencia doméstica case that you find in your law practice?

It’s the emotional part of being with your spouse, or your partner, or your girlfriend, or your boyfriend. Because there is a level of love. And when that happens, oftentimes it’s because the emotional anger has gotten out of hand.
And many times, the accuser no longer wants to go forth. They don’t want to cooperate. They don’t want their partner to be incarcerated or have a charge. But once that phone call is made, once you ring that bell, it’s hard to un-ring it. And law enforcement, prosecutors are going to try to do what they can to protect you, even though you have, as the accuser, have recanted.
And if you recant, and you say that it didn’t happen, then you’re subject to perjury, and that’s going to put you in a bad situation. So, it’s another one of those workshops where everything you can do up front, to walk away, to not engage and to not have to call law enforcement, to become part of your private life, will give you the ability to control what happens in your life. But once that phone call is made and you are walking into the criminal justice system, you have no more control of what’s going to happen.
