Well, it doesn’t sound like there’s a bright line in between where there is no medical malpractice, yet there was a bad outcome, and then there is a medical malpractice witha bad outcome. It doesn’t sound like there’s a bright line there.
Mark Kaire – Medical Malpractice Attorney – Miami-Dade County, FL
There is no bright line. Now, that is correct. Every case is individualized and on its own merits, and there’s nothing that we can point to that says X leads to Y. So that’s why negligencia médica is such a subspecialty, and there is no bright line either, even in terms of determining what is and what is not, quote-unquote, medical malpractice or a departure from the standard of care. That is also very individualized and very fact-specific and case-specific.
