Well, certainly for starting the case out, yes. And then it does become a battle of experts, which expert is more credible.

And, you know, I think at the end of the day, the plaintiff has so much to do with it.


What is… what happened? What is the story about? Is it an easy case for the… for the jury to understand? Is it a case that is emotional, is going to bring sympathy, even though sympathy is not supposed to play a role in the jury’s verdict and decision making?

At the end of the day, that what drives everything. So, we can talk about medicine in a vacuum and we can talk about, in fancy terms, of about what this doctor should have done or should not have done but at the end of the day is the case relatable as humans and is it something that pulls at your heartstrings when you hear the story.

And that’s what I think… that’s… you know, at the end of the day, we can have the best experts from the best schools or the best teaching institutions or the best hospitals, yes that helps, but at the end of the day, it’s about the person, it’s about the people.
