No, no. One, one error will suffice there. You don’t need a history of repetitive errors for a doctor to then level criticism of that doctor. In fact, they’re not admissible.

When the doctor starts, when, when the expert reviews the case, it is a case that is being reviewed on its own merits, irrespective of the doctor’s prior history, prior lawsuits, settlements. None of that is material unless you’re perhaps bringing a claim against the hospital for negligent credentialing, which will take us down a different path. But for terms of this doctor’s medical malpractice error on a particular patient, it’s viewed in the vacuum of just that one case.
