“There could be differences in all those respects. Certainly, the defendant, or the at-fault party, who that is, certainly could make a difference. If you’ve got the at-fault party, somebody who has very little insurance and no assets, the available money to the claimant, to my client, would be much less than if it’s a high-powered big corporation with big insurance policies with more access to funds.
Certainly, the access to funds is an aspect of it, but at the beginning of a case, at least most of the cases that I work, at the beginning of the case you’re not going to really know the severity of the injuries or how long it’s going to take to recover. I mean, some cases, obviously, you’re going to know. You’ve got some broken bones, you’ve got surgery, you’ve got things like that. Those are going to be a little more obvious. Sometimes, you’re going to have a soft tissue case where there’re not obvious injuries like that, but because of several different factors this person never fully recovers, and the value of the case is higher than one would think.”
