“The question is, there was an express warranty of a year in that case. And the question is, was there an implied warranty that actually extended beyond that year? There may have been. That’s what you’ll find out in court, if not, if you can’t figure it out before then. And the way you find it out before then is you get the orthodontist, or whoever he was, the dentist, to honor that implied warranty, and say,
‘oh yeah, it’s after the warranty, but I agree that it should have lasted longer. So, therefore I will fix it.’
That’s a voluntary agreement to comply with an implied warranty.”
