“Is that the preponderance of the DUI stops? It’s an alcohol related violation versus a drug related violation?”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“Yes, most of the time. That is where they have certain things that they’ve identified. That alcohol is usually the culprit of… Zigzagging, driving patterns, erraticness, or even very, very slow…or something out of the norm. That just that… they haven’t necessarily done that for all the different types of narcotics that are out there. I mean, some may affect you in a hyperway, some may effect you in another…some may not really affect your ability at all that much. But they know what to look out for in terms of alcohol. And then usually, if they don’t, if they do…they can ask you for the blood alcohol test. And let’s say, you score 0.0, there’s no blood alcohol. Usually at that point they ask you for a urine.”

“Oh, really?”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“They’ll think something is going on.”

“And so it might be, well, it might not have passed to your blood at this point in time, but of course, it will still be in your system and in your urine. So, that’s what you’re saying, it’s the net period of time, okay.”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“And they’ll ask you for it. They usually ask it for a urine, if you pass the blood alcohol, instead of letting you go, they’re like, okay, let’s do more test. Got to be on something, you know. So, just because you pass the test doesn’t mean you’re going to be let go.”
