In my research for this interview, I realized, well, again, I have to take, and everybody should take, what is online, somewhat with a grain of salt, because you’re never quite sure whether that data is accurate or not. I did read that medical malpractice litigation is only successful 10 to 20% of the time. And please tell me if what I read is correct or not. And yeah, no, no, please.

Mark Kaire – Medical Malpractice Attorney – Miami-Dade County, FL

Let’s start with that. Excuse me, the statistics that you’re alluding to are cases that are actually tried. That doesn’t talk about cases that are settled.

And the cases that are tried are usually tried because the insurance company is pretty good about picking and choosing which cases they want to try.

That makes sense.

They have the data to back it up and they feel fairly confident when their position is no, we’re not paying you a penny. They feel pretty confident that those are the cases that they want to take to trial.

Well, of course, with that, the data is skewed, of course, absolutely.
