“Somebody walks into your office. And what is the most common misconception? When somebody comes to see you, a criminal defense attorney what’s one of the most common misconceptions? When they sit down in front of you and they start talking, you realize, oh, man, let me correct this.”
Kirk Tarman– Criminal Defense Attorney – San Bernardino County, CA
“Yeah. Well, I’ll tell you the one. And so I was just talking about it with one of the girls. The charge on everybody’s ticket says, CVC21352A, in parenthesis, and then it says, impaired. And then it will say, CVC21352B. And then it will be in parenthesis, and then it will say less than… the little symbol of less than, or equal to 0.08.
Everybody believes that that 0.08 is what they…their blood alcohol was at the time of their arrest. It’s just the name of the charge. So, that is a very common problem. So, my gosh, yeah, because look, at .08…man, I get a lot of action. I’ll have a lot of action on a 0.08. I’ll be able to get that. I’ll be able to win that or get that a wet reckless. Super easy, driving reckless. Even maybe some moving violations.”
