“Well now, you started… now, you started touching on search and seizure, it’s obviously the search aspect of this, and there are some very serious, or let’s say, strict, and then, of course, serious requirements for law enforcement before they can take that action. You’ve obviously touched on it. And you just mentioned, and I’d like you to maybe discuss this a little bit more. They’re not supposed to stop somebody longer than it takes to write a ticket. You said that…”

“Yeah, that’s for a traffic infraction. Everything that’s in an infraction, doesn’t carry jail. It is a ticket. You’re only supposed to stop the person long enough to get their information to write the ticket, and you let them go on their way. This is not an opportunity to get into everything they have. But that happens quite often.”

“That’s what I was going to ask. Then they start getting into the search aspect that we’ve just been discussing here.”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“Correct. Getting you out of the car, and oh, and then let’s say they find something. And then… who cares why we stopped you. Look what we found. You know, guns…another one that’s very big. Because guns can be legal. Cocaine is always illegal. Guns can be legal, and they can be illegal. That’s one of the things, they find that, and most of the time, they’re going to arrest you, even if you have a gun license, they’re going to say that you didn’t carry…you didn’t carry a concealed weapons charge… you didn’t do it according to…what the law says. They will find a way to arrest you, because they don’t normally want anybody running around with a gun.”
