“There’s a third scenario where parole can be granted, and that’s in felonies. And it wasn’t that common, about 10 years ago, until the legislation started to change. Now, it’s much more common. What happens with parole as an alternative, for offenders… in the old days, if you were in jail and you came out, it was called probation. If you went to state prison and got out, it was called probation.
Most of my clients tell me that probation is much more onerous. Or they feel it’s a greater burden, a greater weight for them. And so the idea of having parole sounds better to them. It may be exactly the same, but if you consider the alternative of the county jail versus the state prison, the state prison always seems more serious and a heavier burden. Now, along with the parole available for felonies, where offenders can really avoid all incarceration and not even bracelets, they can simply be paroled.”
