The preparatory actions they take before contacting you at the scene of an accident and then afterwards, you know, medical records, et cetera, et cetera, is extremely important to be able to move the case along.

I won’t say that it’s the end all of the case if people don’t act in the way that I would hope that they would act after an accident. Most times people are just concerned about their health and their safety and they’re not really thinking about what if I file a lawsuit in the future.

Well, they’re emotional at that moment.

No question because you’re scared, you’re shaking up, sometimes you’re angry, you might have family members in the car with you, you might have a child in the back seat. There are so many other things that you might be concerned about at that moment.
So, you’re not really thinking of a lawsuit… what do I do in the event of a lawsuit? But sometimes if somebody hears this before they’ve been into a car accident, maybe they’ll take these actions to protect themselves.
And certainly getting information at the scene, looking for witnesses, and if there are witnesses, you don’t know how many times I’ve spoken to clients where they say, I know that this person was there, they know that the accident wasn’t my fault, they told me that they saw that the person came out of nowhere and struck me.
Well, what is that person’s name? I didn’t get their name. What is that person’s phone number? I didn’t get their phone number.
So, it’s a lost witness and a lost opportunity but again people aren’t necessarily thinking about those things at the time of the accident but if you… if somebody hears this interview and if it sticks in somebody’s brain and maybe they remember to do this if they… in the event that they do get to a car accident then it certainly could be helpful.
